However, the question becomes where do you draw the line on what constitutes "tax strategy patents?"

For example, Intuit produces the well known software Turbotax and Quickbooks. To protect their investment, Intuit has hundreds of patents and patent applications in this field of endeavor. Both of these products include "what if" options to determine tax consequences. As is apparent, it becomes a slippery slope when attempting to define what constitutes patentable subject matter and what should not be included.

In terms of the pending legislation, there are significant changes proposed that could be detrimental to individual inventors and small businesses by changing first to invent to a type of first to file system.

My personal opinion is that the current bill should be scrapped in favor of a simpler bill which actually addresses known problems with the US patent system. As is apparent, I am not a supporter of this legislation as it currently exists.

It has not happened a lot lately. Like most legislation, there is a lot of "stuff" in this bill, in addition to the words addressing patents on tax strategy.
